Terms of service

Last updated: September 2026. These terms apply to every use of Yousual.

1. Who we are and what this covers

Yousual is a software service operated by [COMPANY NAME], [COMPANY ADDRESS] ("we", "us"). It is offered to businesses ("you") as separate products that can be turned on per establishment: Yousual Menu (a digital menu behind a QR code), Orders (ordering from that menu for dine in, pickup or delivery) and Yousual Loyalty (a loyalty card your customers add to Apple Wallet or Google Wallet).

By creating an account or using the service you accept these terms. If you do not accept them, do not use the service.

We only provide the tool. Preparing, delivering, charging for and serving what you sell is entirely your responsibility. We are not a party to any contract between you and your customers, we do not process payments between you, and we take no part in your commercial operations.

2. Accounts and access

To use the service you create an account with a valid email address and a secure password. You are responsible for:

  • keeping your login details confidential;
  • every action taken from your account;
  • the access you grant to managers and staff.

If you suspect unauthorised access, change your password immediately and contact support if needed.

We may suspend or close an account in case of abuse, fraud, breach of these terms or non-payment.

3. Acceptable use

You agree to use the service only for lawful, professional purposes. It is forbidden to:

  • use the service for an illegal, misleading or fraudulent activity;
  • publish hateful, violent, discriminatory or otherwise unlawful content;
  • impersonate another business;
  • upload images, logos or text you do not have the rights to;
  • probe, reverse engineer, scrape or copy the service's infrastructure;
  • send unsolicited or misleading messages to customers through the loyalty program.

4. Your content

Your menus, prices, photos, logos, loyalty settings and customer messages remain yours. You grant us the licence needed to host, display and deliver them to your customers through the service, and nothing more.

You are responsible for the accuracy of what you publish, including prices, allergens and availability.

5. Your customers' data

When a customer joins your loyalty program or places an order, we process their name, phone number, orders and loyalty activity on your behalf so that the service works. For that data you are the data controller and we are the processor. You are responsible for informing your customers and for having a lawful basis to contact them.

We do not sell customer data and we do not use it for our own marketing. See the Privacy policy for details.

6. Trial, subscription and payment

Every new account starts with a 15-day free trial. No card is asked for at sign-up and nothing converts automatically: at the end of the trial the account becomes read-only until you subscribe.

Subscriptions are billed per establishment for the products you turn on. Prices, billing periods and payment methods are shown at the time you subscribe. Online payment is being set up; until then, to activate or renew, write to support@yousual.app.

A period already paid for is not refunded, in whole or in part, except where the law requires it. You may stop at any time; access continues until the end of the paid period.

7. Availability and changes

We work to keep the service available at all times, but do not guarantee uninterrupted operation. Maintenance, incidents at our hosting providers, Apple, Google or messaging providers may cause interruptions.

We may change or improve the service, add or remove features, and update these terms. Material changes are announced in the dashboard or by email; continued use after the change counts as acceptance.

8. Liability

The service is provided as is. To the extent permitted by law, we are not liable for indirect losses, lost profits or lost data, nor for damages resulting from your use of the service, from your customers' actions, or from third-party services such as Apple Wallet, Google Wallet or WhatsApp.

Our total liability for any claim is limited to the amount you paid us in the twelve months preceding the claim.

9. Termination

You can delete an establishment or your account from the dashboard at any time. Deleting is permanent: menus, orders, customers and loyalty cards are removed and wallet passes stop updating.

We may terminate an account that breaches these terms, with notice where reasonably possible.

10. Governing law

These terms are governed by the laws of [JURISDICTION]. Any dispute that cannot be settled amicably is submitted to the competent courts of [JURISDICTION].
